Attorney Don Foley is experienced in appraisal litigation and has successfully represented licensed commercial and residential real estate appraisers in State and Federal Courts regarding suits that claim over-stated opinions of value, as well as other violations of USPAP Standards. Mr. Foley’s representation covers suits that were filed against appraisers by their clients, as well as suits brought by third parties claiming damage against appraisers. Mr. Foley is also experienced in applying Indiana’s Comparative Fault Statute that allocates damages to parties other than the appraiser who contributed to damages. Mr. Foley is experienced in the mediation of State and Federal appraisal cases.
Mr. Foley is experienced in, and has successfully represented, real estate appraisers sued by the Indiana Real Estate Appraiser Licensure and Certification Board (also called The Indiana Appraisal Board) for violation of USPAP Standards in mediation of the State’s claims and in Board hearings.
